Trademarks

WILDANGER provides comprehensive advice - both in and out of court - on trademarks, company names and indications of geographical origin. In the enforcement and exploitation of these intellectual property rights, WILDANGER has among its clients nationally and internationally active owners of such rights - from medium-sized companies to large corporations. This applies both to German trademarks and to Community and internationally registered trademarks.

It is also one of our tasks to advise and defend our clients out of court as well as in court, if claims under such intellectual property rights are asserted against them..

WILDANGER has been involved in a number of landmark trademark decisions, including decisions of the European Court of Justice (e.g. "Thomson Life"). We represent the interests of our clients before all German courts responsible for trademark and Community trademark litigation as well as before the European Union Court of Justice (EuG) and the European Court of Justice (EuGH), e.g. in actions against decisions of the Boards of Appeal of the European Union Intellectual Property Office (EUIPO).

In addition to the judicial enforcement of or defense against trademark claims, WILDANGER is also experienced in dealing with border seizure applications for the earliest possible prevention of the import of infringing products by customs. The same applies to the obtaining of search warrants and orders for preservation of evidence.

Finally, WIDLANGER has extensive experience in the exploitation of the aforementioned intellectual property rights, in particular through their out- or in-licensing, be it within the framework of pure licensing agreements or in connection with contractual arrangements going beyond pure licensing, such as cooperation agreements, etc. For expertise in licensing and other contractual issues see also here.
